Rewards Program Terms
The UNFAIR REWARDS Program (“Program”) is a promotional loyalty program offered by SO UNFAIR, LLC (“Company,” “we,” “us,” or “our”) to reward and thank loyal customers for purchasing qualifying purchases through the Company’s official sales channels. Please read these Program Terms and Conditions (“Terms”) carefully before joining the Program. By becoming a Program member, you agree to be bound by these Terms, the Company’s Terms of Service sounfair.com/pages/terms-of-service and the decisions of the Company on all matters related to the Program. The Company’s decisions on membership, including individual termination of membership, are entirely in its sole discretion.
These Terms do not alter in any way the terms or conditions of any other agreement you may have with the Company for other products, including the Company’s Terms of Service. For any dispute, claim, or controversy arising out of or relating to these Terms, please review the Company’s Terms of Service available at sounfair.com/pages/terms-of-service for binding arbitration terms.
The Company reserves the right to terminate, revise, change or modify the Program, these Terms, or any policy, FAQ, offer, promotion, benefit or guideline pertaining to the Program or rewards, in whole or in part, at any time and in its sole discretion, with or without notice. Any changes or modifications will be effective immediately and may be posted to sounfair.com, so please check back from time to time. You waive any right you may have to receive specific notice of such changes or modifications, and your continued access to or participation in the Program following any such changes or modifications confirms your acceptance. If you do not agree to these Terms, you must stop accessing and participating in the Program.
Section 1. Eligibility
To participate in the Program a member must be at least eighteen (18) years of age and subscribe to the Program (“Program Member”). The Program is intended for personal use only. Commercial use is prohibited. The Program is not targeted towards, nor intended for use by, anyone under the age of 13. Only Program Members are eligible to redeem loyalty points for rewards. All loyalty points are non-transferable.
Section 2. Program Participation
You are responsible for reading these Terms to understand your rights, responsibilities, and status in the Program, as well as how to earn and redeem loyalty points.
To be a Program Member you must create a loyalty account and enroll in the Program. There can only be one loyalty account per Program Member. Any personally identifiable information collected from a Program Member in this Program will be subject to our Privacy Policy which is available at sounfair.com/pages/privacy-policy
You must provide correct information when enrolling. Providing fictitious, incorrect, or false information may result in termination of your membership and forfeiture of all existing loyalty points and rewards.
There are no participation or membership fees associated with the Program.
Loyalty points have no cash value, are not redeemable for cash, and may not be transferred, purchased, sold, or bartered. The Company reserves the right to adjust any balance resulting from fraud, malfunction, or operator error, at its sole discretion.
Section 3. Earning Loyalty Points
Customers earn one (1) loyalty point for every one U.S. cent ($0.01) spent on qualifying merchandise, calculated based on the actual purchase price paid, excluding taxes, shipping fees, and other non-merchandise charges. Points are awarded only after a qualifying purchase has been successfully completed.
If a customer has a loyalty account, points earned are recorded within the customer’s loyalty account associated with their purchase. Points will not be earned on purchases made when checking out as a guest and the Company shall not be responsible for crediting or awarding any points for purchases that were made by a guest or that are not otherwise linked to the customer’s loyalty account.
From time to time, the Company may offer customers opportunities to earn additional loyalty points through special promotions. These promotional loyalty points will be awarded as described in the applicable promotional offer and will be subject to any additional terms set forth in such promotional offer. Offer(s) subject to change, and may be modified, suspended or terminated at any time without notice. Offers are void where prohibited by law. Other restrictions may apply.
The Company reserves the right to review and investigate all offer activities, and to suspend accounts or remove points and any other promotional benefits for suspected abuse, violation of terms, or fraud.
Section 4. Redeeming Loyalty Points
Only Program Members may redeem loyalty points for rewards available through the Program.
Rewards may include promotional merchandise, services, experience or other items designated by the Company from time to time.
Rewards available for redemption may be changed, substituted, limited, or discontinued at any time without notice.
Program Members may redeem no more than three (3) of any individual reward item, unless otherwise specified.
Rewards redeemed through the Program for merchandise will be shipped free of charge to the Program Member within the fifty United States unless otherwise stated. Rewards redeemed through the Program for merchandise and shipped outside of the fifty United States may incur shipping charges.
The redemption of loyalty points accrued in connection with the Program cannot be combined with any other offers or discounts, unless otherwise expressly indicated by the Company.
Section 5. Point Expiration
Loyalty points will expire twelve (12) months after the date they were earned if they are not redeemed. Expired points may not be reinstated.
Section 6. Refunds and Adjustments
If a purchase that generated loyalty points is refunded, returned, canceled, or otherwise reversed, the associated loyalty points will be deducted from the customer’s loyalty account.
The Company reserves the right to adjust or correct loyalty point balances at any time to address errors, returns, or system issues.
Section 7. Referral Rewards
Program Members may have the opportunity to earn loyalty points by referring new customers to the Company through an official referral link or referral tool provided by the Company.
A referral reward will be issued when a referred individual completes their first qualifying purchase using the referring Program Member’s unique referral link.
Referral rewards:
- Are limited to one (1) referral reward per new customer
- Apply only to the first completed qualifying purchase is made by the referred customer
- Will be issued only after the qualifying purchase is successfully completed and not subject to refund or cancellation
Self-referrals are strictly prohibited. Program Members may not refer themselves using alternate accounts, email addresses, identities, or payment methods.
The Company reserves the right to withhold, delay, or revoke referral rewards in cases of suspected fraud, abuse, manipulation of the referral system, or violation of these Terms or the Company’s Terms of Service. Referral reward values and referral program rules may be modified, suspended, or discontinued at any time.
Section 8. Reward Availability
Rewards offered through the Program are available while supplies last and may be limited in quantity. Certain rewards may be offered in limited quantities, limited redemption windows, or limited promotional periods, and availability of such rewards may change without notice.
The Company reserves the right, in its sole discretion, to limit the number of rewards available for redemption, modify the redemption requirements, substitute rewards with items of equal or greater value, or temporarily suspend or discontinue redemption of specific rewards due to inventory availability, operational considerations, or other business reasons.
Redemption of rewards does not guarantee immediate availability or shipment, and rewards may be fulfilled in a commercially reasonable timeframe determined by the Company.
The Company further reserves the right to delay, deny, or cancel reward redemptions in cases of suspected fraud, abuse of the Program, system errors, inventory discrepancies, or violations of these Terms.
Section 9. Program Abuse and Enforcement
The Company reserves the right to revoke loyalty points, suspend accounts, cancel rewards, or terminate participation in the Program if it determines, in its sole discretion, that a participant has engaged in:
- Fraud
- Abuse of the Program
- Manipulation of the Program
- Use of multiple or fraudulent accounts
- Violation of these Program Terms or the Company’s Terms of Service
Without notice to the customer, the Company reserves the right to suspend and/or terminate a customer’s loyalty account and/or the customer’s participation in the Program if the Company determines, in its sole discretion, that the customer has engaged in the activities described above or otherwise violated these Terms. The Company may, in its sole discretion, suspend, cancel or combine loyalty accounts that appear to be duplicative. In the event that a customer’s participation in Program is terminated, all accrued points in the customer’s account are void. The Company’s decisions regarding Program enforcement are final.
Section 10. Program Changes or Termination
The Company reserves the right to modify, suspend, or terminate the Program or its operation at any time, including but not limited to changes to:
- Loyalty point values
- Redemption requirements
- Reward availability
- Referral rewards
- Eligibility requirements
- Program rules or benefits
The Company may also limit, restrict, or terminate a customer’s (including a Program Member) participation in the Program at its sole discretion.
Section 11. Limitation of Liability
To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, consequential, or special damages arising from participation in the Program or from the redemption of rewards.
The Company makes no guarantees regarding the availability of rewards, the continued operation of the Program, or the accumulation of loyalty points.
Section 12. Governing Law
These Program Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Section 13. Dispute Resolution by Binding Arbitration & Class Action Waiver
For any dispute, claim, or controversy arising out of or relating to these Terms, please review the Company’s Terms of Service available at sounfair.com/pages/terms-of-service for binding arbitration terms.
By participating in the Program, you agree that arbitration shall be conducted on an individual basis only and not as a class, consolidated, or representative action, and you expressly waive any right to participate in a class action lawsuit or class-wide arbitration. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
